Following the passage of the Inflation Reduction Act of 2022, Congress established the Methane Emissions Reduction Program (MERP) under Section 136 of the Clean Air Act. This law imposes a Waste Emissions Charge (WEC)—a fine levied on operators who exceed methane emission thresholds set by the EPA. Beginning at $900 per metric ton of excess methane in 2024, the penalty increases to $1,200 in 2025 and $1,500 in 2026 and beyond, posing serious financial risk for non-compliance.
